and it will add to the distrust that many have of the federal government. >> it is absolutely chill that this irs was singling out conservative groups for extra review. i think it's very disappointing that the president hasn't personally condemned this. >> reporter: nearly two full years ago on june 29, 2011, lois learner, the director of the irs division in charge of tax-exempt status was part of a briefing where she learned groups were set sside for extra security if they had tea party, patriot or 912 in their title. and those with government debt had their cases stont specialists. learner ordered that criteria changed right away. but she is still saying, she is sorry. >> i think we, the irs, would

like to apologize for that. it was not intentional. as soon as we found out what was going on, we took steps to plac it better. i don't expect those things to re-occur. >> reporter: after lois lerner ordered the change, her boss, the irs commissioner, denied any knowledge of targeting conservative groups ever -- at least five times. now the white house is saying if the inspector general finds any rules were broken or they didn't meet the standards required of them, the president expects that swift and appropriate steps will be taken to address any misconduct. irs commissioner, doug shulman, appointed by president bush and served for 6 years, left office in november, at the end of his term. >> shannon: he may be called back for more questions. >> i don't care if you are a

conservative, liberal, conservative or republican, this should send a chill your spine. this is something that we cannot let stand. >> shannon: that was congressman mike rogers on fox"fox news sunday," commenting on the scandal. with us, via skype, a senator who questioned treasury secretary about about how the irs has handled private information, considering conservative groups and their donor list as well. senator, thank you for joining us. >> great to be with you. >> shannon: do you think you will get support across the aisle. as your colleague in the other house, congressman mike rogers said, folks across the spectrum should be concerned if the irs is having political attacks made >> shannon, absolutely. this is not a conservative/liberal issue. all americans ought to be interested that the applications for an irs exemption are appropriately handled. from a tax code point of view.

but no american ought to be pleased that political information is being used for political purposes. doesn't matter what your political stripes are. this is highly offensive. this harkens back to days of president nixon and the use of the irs for political purposes. at that point in time -- and i would expect it in america today -- you would see across the board, members of congress trying to find out what the facts are and if those facts demonstrate wrongdoing, heads should roll. >> shannon: what we have been told is that policies were changed. this was corrected. i will ask you, first, if you are convinced that this has been rectified. you mentioned heads will roll. but from what we torunderstand, there has been no discipline and then the follow-up was that they can't comment on personnel actions. >> we are very anxious to see the inspector general's report, expected out in the next few days.

that nonpartisan report, analysts will tell us, as best shows, is what happened and when it happened, who knew and who knew what and what the reaction was. i think the more damaging -- this is a bad thing that any group it would be signaled out, based upon their political leanings, but i had the opportunity to question the new secretary of the treasury, jack lew last week on this topic. and while the release of the information supposedly inadvertent, is what word was used -- but the thing that really bothers me is that this information about who the donors were -- we are learning about how the irs signaled out conservative groups. the next step is to find out the reality-- the truth of that fact. but also, don't forget that the irs eye believe there are three circumstances in which we know that donor informs was provided

to grews across the country that were then used in political efforts. and so conservative donor groups -- that information was provided to liberal groups so the conservatives could be attacked. there is more to this story than signaling out conservative groups. in my view, the next question is, once they are signaled out, how is that information used? and was it used in political campaigns? liberals against conservatives? >> shannon: there will be some type of hearing to probe that. i want to ask you quickly, we are almost out of time, there have been calls for the president to publicly repudiated this. we do have a statement from jay carney say figure they find out irs standards were broken, the president expects swift and appropriate steps will be taken for any misconduct. is that good enough for you? would you like the president to speak out personal? >> i think this is so offensive. certainly as the facts are known, what we know today is

offensive. i think it's important, it's appropriate, it's negligence, for president obama to take ownership. this is not a political issue. it has been reported that the commissioner was appoint bide president bush. but we need to know what has happened since that information was provided to higher-why you weres at the irs. this is agan administration issue, not just an iremarks issue. >> shannon: thank you for joining us. >> you're welcome, thank. >> when ambassador stevens talked to you, perhaps minutes before he died, as a dying declaration, what precisely did he say to you? >> he said, greg, we are under attack. >> shannon: republican congressman tray gowdy is one of the most outspoken critics of how the obama administration has handled the dangerous situation in benghazi before, during and after the attacks that left four americans dead. today, even after the testimony of three whistle-blowers he says there are many unanswered

questions. he joins us now, live. thank you for tuning in with us today? >> yes, ma'am. happy mothers day. >> jamie: -- >> shannon: thank you very much. a lot of colleagues have said this is a political witch-hunt that the whistle-blowers are being used for political purposes by republicans. they say there was nothing new they learn from the hearing. but i have to ask youp about something you mentioned specific that was new to me -- maybe they knew this. an email in september, i believe on september 12 that involves the active secretary for near eastern affair, beth jones. for folk who is didn't see the hearing, walk us through that? >> september 12, in fact, just after noon, september 12 and beth jones, an acting assistant secretary of state, sent an email, essentially telling the libyan ambassador that we know

that this attack was conduct bide a terror group. this is the day after benghazi. you fast forward and president obama and secretary clinton and ambassador rice areuc talking about a video, a spontaneous, not pre-planned, not premeditated demonstration. they knew on september 12 that that was wrong. you go through the 12 iterations of the talking points and victoria nuland, the spokesperson for the department of state, wanted the talking points edited because they were fearful that the department of state would be criticized. my colleagues -- so you know -- my colleagues always say that -- it's not true, it's not true and then they say it's old news. you are never going to get them to say, that's an interesting revelation in the hearing. but trust me, they were surprisemented they didn't know it. the administration didn't know we had that email. it was a damaging to the narrative put forth by jay carny

and this administration. >> shannon: speaking of damage, you said to the families of the victims, you said, you don't care -- quote, don't give a damn whose careers are impacted. you are going to get the answers. at this point, with four american lives losten and and many others in danger, whose career do you think is being protected at this point? [chuckles] >> well, i think prior to november's election, it was a concerted effort to savor guard and protect the president's second-term aspirations. he's been re-elected, in part because we didn't have all the answers to benghazi. dubut let's don't kid each other, hillary clinton wants to be the president of the united states. if he wants to rub, that's great. but she is going to give an accounting for why she was obsessed with benghazi. why she approved a facility that didn't need meet specifications. ey she is going to give an account on what role if any not to send assets in the siege and

she meest assuredly will give an accounting for the role she played in keeping the truth from the american people for weeks and months and months after benghazi. the only explanation i can come up with, people don't lie when the truth service them better. they don't. they tell the truth when it serves them better. we are going to find out why they misled us and we are going to find out, no matter how many witnesses we have to call and how many "saturday night live" skits want to mog it, we are going to find out whether hillary clinton like its or not. >> reporter: what about the allegations that this is all about stopping hillary clinton from becoming president in 2016? >> i wish i had the power to do that. whether she runs for president is something she will have to decide. she can't have it both ways. you can't go on a farewell tour, talking about how great you were as the secretary of state and not have to be held responsible

and accountable for decisions made on your watch. let's assume arguendo she wants to run for president, we call that commandener chief, right? that's the commander in chief. so is she eligible for a promotion? based on how she handled the body of work that she hash as the secretary of state? i may not be in politics in 2016 -- who knows where i will be? i will tell thu. i'm a former prosecutor that has looked at spouses and parents and children who have suffered at the hands of murderers. if nothing else, politics aside, i want to give those family members the peace of knowing what happened to their loved ones and the politics can fall wherever it may. >> shannon: congressman, gowdy, we know this is frar over. thanks for making time for us today. >> yes, ma'am, thank you. >> shannon: in trenton, new jersey, authority says two bodies have been found in a home where a days-long hostage

standoff came to an end this morning. it is believed 44-year-old marmleita stevens and her teenaged son. stevens may have died two weeks ago. her three other children were rescued when the suspect was shot and killed, gerald murphy. >> murphy was wounded wounded an to the medical center and he has since died of his juries. >> reporter: murphy was stevens' boyfriend. the three children were taken to the hospital for evaluation and treatment. a 12-year-old in northern california is being charged with his sister's murder. 8-year-old leila fowler was found stabbed to death in april. the boy at the time made accusations about a gray-haired intruder in the home. >> reporter: shanoon, police had a massive manhunt, search dogs,

dragging a nearby lake, pulling in parolees and sex offenders. clearly, police believed the initial story that the boy and his storysister were home while the parents attended a little league game. the boy claims to have seen the killer with long gray hair, flee the house. he called 911 and a neighbor initially corroborated that story and later recanted. police had combed the house for fingerprints and dnscpa likely came up empty on the intruder and began to focus on the 12-year-old brother. heed hiding in plain sight, seen many times publicly, including a candle-light vigil. leila died from multiple stab wounds. police seized several knives from the home. the brother and sister were close and friends say he treated her well. imagine the shock when police announce that the killer was leila's brother. >> citizens can sleep a little

>> shannon: have you to see this to believe it. two dangerous run-ins with ice, 600 miles apart. this thaw of ice came into homes. hundreds of miles north, the same thing happened in a rural area near winnipeg, canada. a giant wall of ice slammed through 20 homes there. it is unbelievable, looking at the pictures. but nobody was hurt in either incident. an ohio prosecutor may seek the death penalty for the man accused of holding three women hostage more than a decade, as new details emerge about the conditions the women endured.

>> reporter: good morning, shannon. the three women, telling police that they were bound with ropes and chains, raped and beaten repeatedly over 10 years in captivity. now we have dramatic video of their rescue. a neighbor capturing it on her sole phone. you can see on the front porch of the home, police swarming the home, preparing to break down the front door, this, of course, after amanda berry's heroic 911 phone call after she escaped. this past hour, lawyers released statements from the three women, thanking the community and the police for the outpour of support and love from the past week and the past 10 years. gina dejosussaying they are so happy to be home. they are asking the public, the media and everybody for time while they heal and as they try to adjust to life outside captivity. take a listen. >> they have asked, in fact have

and forth, all this week. after they finish with it. i predict they will adopt a bill, then tell go to the senate floor, probably in june. >> shannon: do you think there is going to be a lot of pressure on the g.o.p. to coalesce, because there are people who have strong objections and questions. we saw senator ted cruz, he is one of them. there are others. would it be beneficial to find a common ground signal they be allowed to offer amendments? >> the democratic leader, harry reid will be smart if he allows the process to work through the regular order -- meaning you bring the bill to the floor from the judiciary committee, you allow amendments and time for debate, even if it takes two or three weeks,s a big deal and it requires that much time. and then have you a final vote. and it is adopted. then it is more meaningful if the house of representatives. if he were to try to jam it through, republicans could come plain that they didn't have all

of the parliamentiary rights they are intielged to it and it would have a harder road in the house of representatives. i think he will give it a good two or three weeks in june so it has more saliency in the house of representatives. >> shannon: what role should the president be playing? we are looking at a bipartisan group of senators. but ultimately, it would land on his desk. >> this is a matter of debate. i don't think it's inappropriate to say on both sides, both of them are just as soon stay in the background. if he wades into this, it make its partisan and more difficult for republicans. i think the democrats are doing just fine. i think i would subscribe to the view as long as it's moving forward, it is better for will him not to engage in a way that the republicans could react negatively to because of partisanship. >> shannon: this is a large, comprehensive measure. but in that respect, every time folks dig in and they find a new

nugget they are unhappy with, it creates problems for bill. do you see it as one big reform package? or do you think they pick it off? >> i think the senate will pass a big, comprehensive bill, probably after more amendments are adopted. in the house of representatives, it is unclear. one theory is that different committee chairman will take och different bills. for example, in the judiciary committee, they may take up the e-verify bill, requiring employers to use the social security database to confirm eligibility for employment. they may go at it one bill at a time and bring those bills independently to the floor or try to put them into comprehensive bill on the floor. i don't know what they are going to do there. with an issue like this, it is very difficult to do it one piece at a time because the side that doesn't get what they want wants to hold off support until they get what they want.

you put together a comprehensive bill. that's why, even though it's unwe wouldy in a way, the comprehensive bill that the senate is moving forward on does make some sense. >> shannon: we'll see how it plays out. britain's prince harry will be in colorado springs to start the warrior game, a u.s. parolympic event for ilscpil injured service members and veterans. we have more from colorado. >> reporter: how are you, shannon? it's kicking off here in the next half an hour to hour or so. prince harry will be arriving here to begin a couple of cycling event, kicking off the warrior games. we saw the prince yesterday with missy franklin and brad snyder, starting the actual games by lighting the flame. the prince was part of the torch relay that kicked off in ernest, a moving event as around 300

injured personnel arrived to see the opening ceremony take place. and then, about an hour after the opening ceremony, we saw prince harry really getting quite involved in a sitting volleyball competition. prince harry is quite renowned for being highly competitive. had a few words with the referee, nall jest, of course. but he really wanted to be part of the team. it's a real leveler, sitting volleyball, so he may be able bodied, but he was on a level with all the guys playing and helped the british team to victory. prince harry was at a media event. can't go into detail. all kisay, he is absolutely enjoying the warrior games and he is fanatical about making sure it gets as much compel as possible. >> shannon: he has added his name to a worthy cause. thank you very much. it's a gruesome murder case.

>> shannon: the jury resumes deliberations on membered in the trial of a philadelphia abortion doctor accused of warning. the report may contain deil tails that some find disturbing. >> reporter: a source tells fox that the jury told the judge they are, quote, drain the, after nine days of deliberating. so they went home early for the weekend and will be back at it on monday. they have heard grisly testimony about what prosecutors say what went on in dr. kermit gosnell's abortion clinic. some legal analysts say jurors may be struggling over the

first-degree murder part of the case, whether or not four babies survived abortions and were alive as the prosecution argues when dr. goes on goes or an assistant cut their spinal cord with scissors. >> my educated guess, a few jurors have a reasonable doubt. >> reporter: the defense attorney did not call one witness during the trial. instead, he tried to make its case through cross-examinations of the prosecution's witnesses, maintaining that any arm or leg movement or cries or moans by the babies were not signs of life, but rather, post mortem spagsms. what if the jury cannot reach a unanimous decision on the first-degree murder charges? >> the judge will interrogate the jurors and send them back and brow hem-beat them a bit. but once he is satisfied they cannot -- agree, he will declare a mistrial and the state will have to determine whether or not to retry the judge on that

charge. >> shannon: the jury has more than 260 other charges to decide, including third-degree murder of a patient. it may be taking them a while to get through all of those charges. >> shannon: joining us with perspective on the trial, tony perkins, president and ceo of the family research council. what's your impression of this trial, as it plays out? i have to tell you, i have been in philadelphia, tag-teaming with molly and a lot of folks on the street don't know who kermit gosnell is, much less the average american? >> good point, shannon. the reason is the media has ignored this case up until the last three or four weeks. we are well into this. this was two years ago that the grand jury released its report, 250-plus pages of what they called the house of horrors. so you are right. there is not a lot of people who know about it. there is a reason for that. the more people know about what

took place behind the doors of that so-called clinic, i think those who are supporting or advocating for abortion realize that this is not the best face to put on abortion. it shows the true story of this rejection of the value of human life. >> shannon: i thought it wassing into capitol hill, the sense of back and forth. senator mike lee on the republican senate side proposed a resolution, saying it's time for us to review the policy decisions that allowed the alleged conditions in the kermit gosnell trial to come to fruition. and democrats said, let's investigate all substandard abusive, illegal health care, clearly didn't want the word abortion associated with it but say that their resolution would cover abortion fwe're looking at all health care practices. on the house side, pledges to investigate this as well. what do you make of that?

>> i am for good health care. i think we need good standards across the board. but the reality is, shannon, it is the abortion clinics that have intentionally -- if you will -- slipped through the cracks. goes -- goes kermit gosnell's clinic was not investigated since 1993. abortion clinics don't have the same standards as a clinic where vetinariance operate. so they clearly have been carved out and not given the basic health care standards to ensure that women are okay. because in this case, or at least given a chance of basic medical conditions and survival. in this case, it is not just the babies that have died in this clinic, a woman died as well. that's one of the charges because there was not even the basic relationships with the

hospitals, want the basic... connections with the emergency medical facilities. so this is an issue of women's health. i am glad to see that congressman upton and the judiciary committee and the energy commerce committee have reached out to state officials and are saying, hey, are you enforcing current law ?r you regguling these clinics? this is a reason because under obama administration, federal dollars are going into the clinics now. >> shannon: we would hope that regardless of where folks stoond abortion we can agree that we want women to be safe when they seek out medical care. >> thank you. >> shannon: still to come, congressman darrell issa says americans have been lied to for months about what happened in benghazi. others say republicans are politicizing the attacks. il ask darrell issa, when he joins us live in the next hour. ♪

has had a failed policy when it comes to iran sanctions from the get-go. any time they can loosen the sanctions or give waivers to countries or companies they have done so. we will hold them to -- their feet to the fire and say no more waivers, no more exemptions we will hold everyone accountable and make sure that they stop doing business with iran. if they want to do business with iran they are welcome to do so but they can't also do business with the united states. this administration keeps saying all options are on the table. yet at the same time they keep having discussions of the five plus one countries, negotiations with iran. what does that get us? more time for iran to keep spinning the centrifuges. we made no progress. the sanctions haven't been enforced and this policy of the administration has been an utter failure. >> shannon: faifair to say that other administrations didn't do as good a job as well?

to the accusations this is a political witch hunt and going after democrats and hillary clinton in particular and her hopes if she decides to run in 2016. there are already political groups using portions of this investigation and the hearing in ads going after hillary clinton. how you do you refute that is what this is about? >> first of all, i had nothing to do with hillary clinton losing the nomination to a freshman senator named barack obama. we are not playing in the democratic pry rathers so we are not even involved in that. here is what we are involved in. three career state department employees came in as qualified whistle blowers told us things that they knew that the american people should have known from the get-go. and i use the word get-go because gregory hicks said within minutes after being told by the now deceased ambassador greg we are under attack he told the state department at his levels all the way to the operations center in washington we are are under attack and knew from the get-go it was an al-qaeda backed september 11th

way to do this sort of coequal investigation. >> shannon: i want to turn to the irs. they admitted and apologized late last week that they looked at groups who were applying for tax exempt status based on social welfare groups, the 0 01 c 4s and looking for the word tea party or patriot or 912 they got extra scrutiny and didn't always get approved, if they did it took months. >> there is an ongoing investigation that is the reason for this epiphany of asking for forgiveness. the irs has to show there are measures to punish those who did it and to prevent it from happening in the future. those are important particularly after you you realize that high ranking irs officials knew two years ago that this was going on and

tenning having denials until a few weeks ago. >> shannon: what do you make of the fact that top leaders of the ers appointed by president bush and the fact that this was happening on their watch. >> i think we have to look past the partisan part of this and the reason is simple. the american people know that if it could happen to a conservative group today it could happen to a progressive group tomorrow. i'm old enough to remember when martin luther king was targeted by federal authorities for scrutiny. that is not the america any of us want to live in. fixing this is about fixing it, of course, for those who are targeted but fixing it for all americans so they never have to question whether their first amendment rights essentially land them in an irs review. >> shannon: during the benghazi hearings there was tack of bipartisanship and republicans saying we don't want this to be about party politics. this would be a moment for bipartisanship. with the irs may have a better

argument of gentlemenning some democratic colleagues along with you on that because of what you just note. >> we expect that me ranking member and i will be doing this arm in arm for that reason of knowing that in the past it has been people on his side of the political aisle that have been targeted and more importantly for the most part the violations here, there are very few political appointees at the ers. these are people who are there who have their own agenda. was it curtailed by political' pointes that remains to be seen. but was it something inherently wrong within the irs that needs to be prevented in the future. absolutely. particularly as you get into complex computer is systems we have to make sure that somebody isn't dropping something in that hurts a particular group or ideology they oppose. >> shannon: do you think there will be pushback on the irs for other things, things related to the new healthcare law, and how that may, you know, intercept

with people's personal political beliefs? >> i think you said it very well. the fact that we expanded the irs role under obamacare is a huge opportunity for an a entity that is already some what dysfunctional to do more harm and so we need assurances and institutional changes to make sure that doesn't happen but we believe that the inspector general's report is going to help with that and we expect to work with that arm so that this not be partisan to that mr. cummings and i can push to get the change and then have the administration administer it in a way that, again, keeps political parties out of it because some day there will be a different president. we don't want any administration to be able to do what this one appears to have done. >> shannon: i think all americans can agree on that regardless of their party. chairman issa, thank you very much for your team. >> thank you. >> shannon: residents abandoning their homes as small cracks in the wall turn into gaping holes.
